You can still get a 1 year extension claiming that your PERM application is still pending. It all depends on the officer that the decision has not been made on PERM application.
The PERM is already denied and you can not get the extension based on the denied PERM.

is you will be paying double fees.USCIS will automatically deny 1 case when the other one is approved.
I am in the same situation (but my PD is 1 year earlier than my wife) but I am just filing my case and holding of my wife's I-140.

I am probably a unique case. I have a H1B that expires in Sep 2009. I work for a strategy consulting firm and as such advise clients on business/Ops strategy. Therfore most of the time I am on a client site. Recently, I moved my residence outside the US to UK. Given the nature of my work, I am able to commute to US every week to my client offices and then return to UK by end of the week. I sometimes have to go to European destinations and so UK actually helps.All through this I am with the same company on their US payroll (have US pay stubs, leters etc to prove). When I am in US, I stay at one of the hotels.
My question to you is, from a H1B standpoint, do I need to do anything different, especially given I am up for an extension later this year. I have an I 140 approved which will be the basis of a potential 3 yr extension.
Also note, that I get a new I 94 every week at the Port of Entry from the IO, so I have to believe that my case gets reviewed due to this unique situation

Few things:
1. The inventory of Pending I485 is not reliable.
2. If they approve all pending EB2 it means they have to move the PD forward and as they move the PD, new applications will be filed. There are thousands of EB2 labor approved and they are waiting to file I-485
3. Even if there is any spillover to EB3, nobody knows how USCIS will give those spillover number, will they go to EB3-ROW first or they will go as per the PD of Individuals regardless of Country of Origin.

Even if your status changed to H1 in October 2004 and you started working in November 2004 for a second employer following approval for that employer, I would say it is just 30days and would not be an issue in future GC application. Don't worry about it.

When there are no job for primary H1s, don't understand why spouses want to work.That's why lot of folks are going back to their native places.Competition wihtin out guys.Its like siblings fighting for same job in a single family.

I have been looking topics like this one. Does anybody know if H-1 H-4 can apply for financial aid? does it come up during GC process as goverment aid and therefore could put you GC approval in danger of being rejected? I read somewhere a list of federal help we can use and be OK. Does someone know where to find info?. I have a daighter H-4 who starts college this year. She qualifies for in state tuiton. Does this affect her GC process? You never know when issues like this will surface along your process. I don't want to make any mistakes. Is someone in similar situation?

Have you tried this option before.
You can use existing visa + new approval notice. Make sure that on arrival the I-94 is stamped until expiration on new approval notice and not the visa expiration date.

There are very few private loan options that you have. If you have a co-signer who is permanent resident or a US Citizen, you have a bigger pool of options but I know of one organization "Access Group" who give out loan if your stay in US is more than 3 yrs + if you have 4 credit cards in your name..You can dig into more details by googling them.
Most of the schools in US also have a tie up with TMS (tuition management system) which let you pay your semester fees in monthly installments. You might want to check that out too. Hope this helps. Good Luck!

Once a person starts working on EAD, his H1 status becomes void. I have read in forum that people still switch from EAD to H1, but I am not entirely sure on that one.
But here is what your friend need to do:
All who are planning to use AC21 or already switched job using AC21 (using EAD). Following is very important:

Person A : PD august 2005 and I-485 filed on : 15 th july
Person B : PD august 2006 and I-485 filed on : 2 nd july
who will get GC first ? Person A or person B ?

Hi .. I am on L1 with my current employer. I applied H1B through a consultancy and my petition got approved. My current employer told me that they can transfer my approved H1B to them. Is it really possible to transfer H1B to my current employer, just by having the approved petition?

Hi ,
I was working for company A and got my labor and I-140 approved and then i changed to company B. My priority date is jan 2005. Is there any way that i can continue my green card process with company A. WOuld be of great help if somone can tell me if there is any way to do it.
