    Hello,

    I am here on a H1B visa and my wife is on a H4 Visa. She has recently been admitted to a masters program and would start going to school soon.

    1. We want to get a F1 visa for her, so that she can get paid for some work in the campus. Would it be possible to get the F1 visa in Canada. Does anyone have any recent experience on getting this done ?
    2. Say we not apply for a visa but only apply for a change of status and do not even go to India or anywhere else before the completion of her program. After that she would go on an OPT. If we go to India then, would it not be a problem in getting a F-1 visa, as her education would already be complete. Does it mean that she should get her visa stamped before she completes her education.

    Hi Gaurav-

    I do not recommend getting a stamp from canada. Sometimes the Consular officer there can not ascertain her past academic record and her F1 may get rejected. I think you should file I539 to change status. That is safest. If, by chance, I539 is rejected, she can apply for F1 at US consulate in India.

    I would advise that you guys travel to India one semester before she completes her studies. One of my wife's friend did that and her F1 was approved despite changing status in US from H4 to F1.

    My wife is also in same situation and has F1 status after changing it from H4. She will be graduating this summer but we may travel to India as not travelling will mean she is away from her family for too long.

    Yes you can transfer based on the receipt number. There is not restriction on how many H1B petition can be filed on your behalf by different employers simultaneously. As long as you have no GAP in your paystubs during this transition you should be OK. I have gone through this experience in the past without any issue.

    Hi Guys

    I have a few questions about what happens AFTER the I-485 is successfully filed?


    How long before you get the notice to appear for finger printing?
    How much time between getting the notice for Finger printing and the actual appointment?
    When does the EAD come through and is there a way to expedite the EAD process?
    When does the process go to the "name check" black hole and you informed about it?


    Any other info by the experienced gurus will be appreciated

    Just make sure at the Port of Entry to show the officer your most recent approval notice and be sure to carry a few pay stubs from your present employer.
    Otherwise shouldn't be a problem at all with the visa stamped valid till next year.

    Hello Bpositive,
    I am in the same situation as you are and have been for about 2 and a half months. I got a yellow slip and still awaiting feedback from the Consulate who in turn is awaiting a response from Washington.

    It depends on when you left the US and if you received your AP before your left the US.

    There was a letter published on November 1, 2007 which can be found here

    If you received the AP before you left the US then there is no risk in returning on the AP from what I have been told but if you did not receive it before you left the US then there is a risk of you entire AOS process being cancelled and this all depends on the officer and the situation at the POE.

    Unfortunately in my case I didnt receive my AP until after I left the US and am awaiting feeback from my lawyer regarding the rule in the link.

    Let me know if you find any other information
    as it would help me as well.

    Please..request that only those with personal experience with this respond. I have to decide in the next hour or so and have lawyer opinions already.

    Has anyone gone through this?

    My H1 is pending 221g admin process (Pink. possibly because I have a Phd in biology) I can't wait much longer as I may risk losing my job. Can I travel on my valid AP? I am not concerned about keeping my H1 status etc. My only concern is at port of entry. Lawyers have told me it is ok, but I would like to hear from people who have done this themselves.

    My cousin brother (15 yrs old) has been recently diagnosed with blood cancer. He is going under treatment at TATA memorial hospital in mumbai. I have posted this before in a different thread and thanks to all for giving me valuable information. The doctors gave him a good chance for recovery. He is going through several bone marrow treatments and regular blood transfusion. We need O+ blood. I would be grateful if anybody can give me some names of prospective donors or donor groups and their contact details in mumbai.     My I-485/I-140 were filed on Jul 2, 2007 (I-140 approved in 9/2007). I possess an EAD valid till Sep 2010 and AP valid till Aug 2009. I lost my job (H1B) in late January. I have a family emergency compelling me to travel to India for a week (starting Saturday next week 04/04/2009). Will there be any problem in terms of using my AP to re-enter the U.S? An early reply would be appreciated. Thank You very much in advance.

    My friend had applied for GC through B (never worked, PD-2004/EB2, 140 approved and 485 more than 6 months) and he was continuing with company A on H1B.
    Company A was laying him off. He tried to go to company B. But Company B was getting folded.
    He went out and got a better offer from company C. He had two choice. Apply H1B transfer from A to C or use AC21.
    He chose to use AC21 and started with C. Lawyer explained the situation with AC21 info to USCIS.

    Now the best part. HE GOT GC last month.

    did you get one? FP is necessary to the EAD
    I filed EAD/AP and I485 together when I filed back in June 2005. I did not do any finger printing for EAD then. But for EAD renewal in 2006 and 2007 March, I applied EAD online. Then I had to go to ASC(Application Service Center) to give finger prints(not all fingers for EAD).
    I'm one like you, check with your attorney for expert advice

    PD : May 2002
    Labor Certified : Mar 2005
    I140/I485 concurrent filing : June 2005
    I140 RFE : Nov 5th 2005
    I140 RFE replied : Nov 20th 2005
    I140 approved : Nov 30th 2005

    Hi,
    I am (L1 B) in US since April 2008 with my wife (L2). Our I-94 and VISA expired on Oct 08. Before expiration my company applied for the extension of L1 (I-129). The status changed to "Request for RFE" on Feb 09. Got the RFE with 11 questions yesterday. The questions asked were more about my specialty, my company and the clients contract, other fellow aliens from my company working for the client's status and profiles. So now not sure what my company will do with the RFE.
    My questions are -
    1. If my company withdraws the L1 Extension petition, then how many more days I will be able to stay in US legally.
    2. My wife is currently 22+ weeks pregnant, will US Govt consider anything for her medical situation?
    3. Whats the possibility that VSC will accept the extension if we send the answers to the RFE?
    4. If the petition is denied, then how many more days I will be able to stay legally?

    I would appreciate if anybody can answer my questions.

    again with Company B and file a new 140 and then use the PD of previous labor to file the 485 etc etc.

    Hi,

    I was working with company# A as Electronics Engineer from Dec ’03 to Jan ’07 on H1B visa, Company# A filed my GC in May ’05 (as Electronic Engineers (Except Computer), 172072.), then later I got very good opportunity in IT field, I quite Company# A and joined Company #B because I build very good relation with Company #A and there were ready to continue my GC file. In August ’07, I filed I-485 (I got EAD based on pending I-485). Now Company #B giving me lay-off, so my question is –

    Company# A still want to hire me after I got GC (because they were very happy with me, right now they don’t have position to hire me back), In this case can I continue working in IT field on EAD status (right now I am on H1B). My current (IT) and Labor profile are both different.

    I don't think so.
    Your GC is sponsored by company A for "Electronics Engineer"
    Your new job in IT would be neither 'Same' nor 'Similar' to the GC job.
    So you cant use EAD to work invoking AC21.

    You can find new employer who can sponsor H1 though and work in IT.
