Hi all, I need help in explaining my situation if someone can help me . Here is my info that I know
EB3 ROW
PD : April 6, 2006 (PERM)
July Filer.
i140 and i485 July 2007 (Received by USCIS Texas Center September 10, 2007)
AP and EAD received September 2007
I want to understand the process so I can know the meaning of the Visa bulletin based on my situation.
I am guessing that right now I will have to wait for my i140 to be approved first before I can talk about i485. I checked the processing time for i140 at TSC and it is August 15, 2007. Any crazy estimate when I should get the approval?
Once my i140 is approved then I can look and match my PD with the visa bulletin EB3 ROW for adjustment of status.
I know there would be some more steps than these above. But are these statement above correct/incorrect?

1) Can my spouses H1b get 7th year extension based on this?
I actually did get a H-1B extension once based on the fact that the spouse (also H-1B) had an approved I-140 priority date that was backlogged. It was an unusual approval, and surprised the other attorneys (including partners) where I was working. It's not guaranteed, but worth a try if there is no other option to work.

My 140 filled on July 6th 2007 . No receipt yet . How to file 485 without 140 receipt ? Is there any solution for this ?

Hi!
My H1B was filed on April 1st 2007 at Vermont Service Center while i was in India and got selected in the lottery. I came to US on May 13th on H4 visa (I 94 valid till July 18, 2008) and still my papers were under process.
On June 1st, 2007 the approval notice was sent to my employer.
Oct 1st, 2007 they applied for my change of status and on 19th it was returned back as a check for 500$ was not included.
Kindly let me know if we could go for a H1B Transfer and change of status simultaneously with a new employer.
Within what time line i need to apply for the same.

hey guys,
i send in my i-140/i485 along with those for my wife. as luck will have it, I forgot to include her sealed i-693. i am planning to send it tomorrow with a cover letter. is that okay? is there anything else I can do?

hi,
They should file form I-130 for you immediately and once your priority date becomes current, you could file 485. You need to maintain status until you file 485. You should not wait until they become U.S. Citizens. You should lock your priority date and it will carry over even if they are U.S. Citizens. Family immigration is on a much faster track now.Take a look at past few visa bulletins to see.

You are not supposed to work on EAD until unless it�s renewed that is sure, you can work on H1B for your H1B employer if H1B is not revoked.

Is it possible to convert or interfile an existing EB based I-485 application to FB based I-485?
I have pending I-485 through an approved I-140 (EB). PD is not current. I recently got married and my spouse is a US Citizen. We are considering pursueing FB application. Reading through the forums I gather that my spouse has to file I-130 and I file for I-485. My question is regarding I-485.
If I have to file for a new I-485, what happens to the existing one? Do I have to get new medical exam? Can I use existing AP, EAD or can I use EAD/AP that I currently have from my EB based application?
If an interfiling is possible, when should this be done - concurrently along with I-130 filing or we have to wait till I-130 is approved? Also what is the procedure for "interfiling"?

This was a complete and total screw up on my part (I forgot my flash was on) but after looking at it for a while....I kind of like it. Last December, 2006 I got laid off because of company downsizing. My last pay stub was dated 12/15/2006. My LC was pending more than 365 days in my last company. Recently I got new job offer. My new company attorney is collecting all my immigration related information for filing H1-B extension from me. I have almost 60 days employment gap when my new company attorney file my 8th year H1-B extension.
I like to know the consequence of my 60 days employment gap. Whether my H1-B extension will be denied by USCIS? I will greatly appreciate your valuable suggestions as I am very much worried.
